BeBest Mobile Application — Subscriptions

1. Parties

These General Terms and Conditions of Sale (hereinafter «GTCS») govern the commercial relationship between:

• BeBest SAS, [registered address], SIRET [to be completed], represented by its President Mr. Clément RIGAL and its CEO Mrs. Anaïs ROLLAND (hereinafter «BeBest» or «the Company»);
• Any adult natural person subscribing to a paid subscription via the BeBest application (hereinafter «the User» or «the Customer»).

2. Purpose and Scope

These GTCS define the conditions under which BeBest offers paid subscriptions granting access to the premium features of the BeBest application: the custom workout session editor, targeted training programmes, and the full exercise video library.

Subscribing to a paid plan constitutes unreserved acceptance of these GTCS. The GTCS take precedence over any other document, unless prior written agreement from BeBest.

3. Offers and Pricing

3.1. Available Plans

BeBest offers monthly and/or annual subscriptions. Current prices are displayed within the application and on the Apple App Store and Google Play Store at the time of subscription.

BeBest reserves the right to modify its prices. Any price change will be communicated to the User with a minimum notice of 30 days before the renewal of their subscription. If the User does not accept the new pricing, they are free to cancel their subscription under the conditions of Article 5.

3.2. Free Trial Period

A free trial period may be offered to new users under the conditions specified at the time of subscription. It is valid only once per user. At the end of the trial period, the subscription is automatically converted to a paid subscription unless the User cancels beforehand.

3.3. Currency

All prices are quoted in euros (€) or Swiss francs (CHF), inclusive of all applicable taxes.

4. Payment Terms

Payment is processed exclusively through the secure payment platforms integrated into the Apple App Store or Google Play Store, depending on the platform used by the User. BeBest does not directly collect or store any banking data.

Subscription fees are automatically charged at the start of each billing period (monthly or annual), unless the User has cancelled in advance under the conditions of Article 5.

5. Subscription Duration and Cancellation

5.1. Duration

Subscriptions are taken out for a fixed term (monthly or annual) and renew automatically by tacit agreement for an identical period, unless cancelled within the applicable notice period.

5.2. Cancellation by the User

The User may cancel their subscription at any time directly through the subscription manager on their Apple App Store or Google Play Store account. Cancellation takes effect at the end of the current billing period. No refund is issued for the period already billed.

5.3. Cancellation by BeBest

BeBest reserves the right to cancel a User's subscription in the event of a breach of the GTC, with prior email notification.

6. Right of Withdrawal

6.1. Withdrawal Period

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the User has 14 days from the date of subscription to exercise their right of withdrawal without providing any reason.

To exercise this right, the User must notify BeBest by email at: info@bebestapp.com

6.2. Waiver of Right of Withdrawal

Pursuant to Article L.221-25 of the French Consumer Code, if the User expressly requests the commencement of service before the expiry of the withdrawal period, they acknowledge waiving their right of withdrawal once the service has been fully performed.

Pursuant to Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium, where performance has begun following the User's express prior consent.

7. Refunds

Except in the case of the statutory right of withdrawal, no refund is due for any subscription period already begun. Where the right of withdrawal is validly exercised within the statutory period, BeBest will process the refund within 14 days of receiving the withdrawal notice, via the original payment platform (Apple or Google).

8. Service Availability

BeBest shall use its best efforts to ensure the application is available 24/7, except for scheduled maintenance. BeBest shall not be held liable for any interruption due to maintenance, force majeure, or telecommunication network failures.

9. Liability

BeBest cannot be held liable for injuries or incidents occurring during physical activity. The User agrees to consult a healthcare professional before using the application and acknowledges training at their own risk.

10. Personal Data

The processing of personal data in connection with the commercial relationship is governed by the BeBest Privacy Policy, accessible from the application.

11. Mediation and Dispute Resolution

In the event of a dispute, the User must first contact BeBest by email at info@bebestapp.com. If no amicable resolution is reached within 30 days, the User may refer the matter to a consumer mediator in accordance with Articles L.611-1 et seq. of the French Consumer Code.

Failing an amicable resolution, disputes shall be submitted to the competent French courts.

12. Applicable Law

These GTCS are governed by French law.
